Please read these Terms & Conditions carefully before downloading, accessing, or using the Food Cheater mobile application or related services.
1. Agreement to Terms & Eligibility
These Terms & Conditions ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and NCWB LTD ("Company," "we," "us," or "our"), a company registered in England and Wales (company number 16587059), governing your access to and use of the Food Cheater mobile application (the "App"), our website, and associated online services or software (collectively, the "Services").
By downloading, installing, accessing, or using the Services, you represent and warrant that:
- You are at least 18 years of age (or the age of legal majority in your jurisdiction). Food Cheater is not for anyone under 18, and the App stops sign-up for anyone who enters a date of birth under 18.
- You have the full power, right, and authority to enter into these Terms.
- Your use of the Services complies with all applicable local, national, and international laws, rules, and regulations.
If you do not agree to all of these Terms, you must not access, install, or use the Services.
2. Crucial Health, Medical, Wearable & Allergen Disclaimers
Food Cheater is not a medical device and does not provide medical, clinical, or nutritional therapy advice.
General informational purposes only. All content, calorie approximations, macronutrient ratios, barcode results, craving suggestions, activity analyses, and insights are automated estimates intended solely for general informational, fitness tracking, and educational purposes.
No doctor-patient relationship. Using Food Cheater does not establish a physician-patient, dietitian-patient, or healthcare provider relationship. The Services are not designed, manufactured, or intended for use in the diagnosis, cure, mitigation, treatment, or prevention of any disease, condition, illness, or eating disorder.
Consult your physician. Always seek the direct guidance of a licensed general practitioner (GP), physician, or registered dietitian before beginning any dietary program, making significant caloric adjustments, or using the App if you have pre-existing medical conditions, take prescribed medications, or are pregnant or nursing. Never disregard professional medical advice or delay seeking clinical attention because of information viewed in the App.
Apple Health. If you connect Apple Health, Food Cheater reads your steps and walking and running distance to estimate the extra calories you burn. These figures come from your iPhone and other devices and are estimates; NCWB LTD is not responsible for inaccurate readings or sync delays from Apple Health or your devices.
Craving suggestions. Craving swaps and similar suggestions are automated estimates. They may be inaccurate or incomplete and are not professional advice. Check them before acting on them, especially if you have allergies.
AI estimates. Photo, Voice, Menu and the Craving Solver use artificial intelligence to recognise foods and estimate portions, calories and nutrients. These are estimates and can be wrong. Check them, and change anything that looks off, before you log them. They are not professional advice.
Allergies and intolerances. Menu picks and craving swaps do not take allergies or intolerances into account. Before ordering, ask the restaurant which allergens a dish contains (in the UK, it must tell you about the 14 main allergens). Before eating packaged food, check its label.
Allergens & food safety. You maintain sole responsibility for reading physical food packaging, inspecting ingredient lists, and confirming food safety before handling, cooking, or consuming any food item. We make no representations or warranties regarding the accuracy of barcode scans, product databases, or algorithmic suggestions regarding allergen cross-contact or drug-food interactions.
Healthy relationships with food. Food Cheater promotes sustainable, balanced nutrition and condemns dangerously restrictive eating or disordered eating behaviours. We reserve the right to suspend or terminate accounts used to promote, track, or glamorize dangerous caloric deprivation or self-harm.
3. In-App Purchases, Subscriptions & Billing
Food Cheater provides core functionality as well as premium subscription tiers ("Food Cheater Pro").
Billing provider. All in-app subscription purchases, billing transactions, payment handling, and refunds on iOS devices are processed exclusively by Apple Inc. via the Apple App Store / StoreKit. NCWB LTD does not directly collect, process, or store your payment card numbers, banking details, or billing addresses.
Auto-renewal. Subscriptions renew automatically on a recurring monthly or annual basis (according to your chosen package) unless canceled at least 24 hours prior to the conclusion of the active billing cycle.
Cancellations. You may manage or cancel your subscription at any time in iPhone Settings › your name › Subscriptions. Deleting your local user profile, erasing your data, or uninstalling the App from your device does not cancel an active Apple App Store subscription.
Refunds & right of withdrawal. In accordance with Apple Media Services Terms and Conditions, all refund claims must be directed directly to Apple Support. For UK consumers, statutory cancellation and withdrawal rights for digital content purchases are administered directly by Apple upon checkout.
Price changes. We reserve the right to adjust subscription pricing. When a price change occurs, Apple will provide advance notice to your Apple ID, allowing you the opportunity to cancel before the updated rate applies on your next scheduled billing date.
4. Your Account and Backup
Signing in. You sign in with Apple, Google or a code sent to your email. Keep that account secure; anyone who can sign in to it can see your Food Cheater data.
Backup. Your profile and logs are stored on your phone and backed up to your Food Cheater account, so they come back when you sign in on a new phone. Changes made while offline are backed up when your phone reconnects; anything not yet backed up when a phone is lost or reset may be lost.
Signing out backs up any remaining changes and then clears your data from that phone. It stays in your account.
Deleting your account. You can delete your account at any time in Settings › About › Delete account. This permanently deletes your data from our systems as described in our Privacy Policy, and cannot be undone. It does not cancel an App Store subscription.
Sign in with Apple. If you stop using Sign in with Apple for Food Cheater, or delete your Apple Account, Apple tells us: you are signed out of Food Cheater, and your account may be deleted if no one could sign in to it any more, as described in our Privacy Policy.
Health information. By ticking the box at sign-up, you consent to us storing your health information as set out in our Health Data Policy.
Using AI features. AI features are on when you create your account, and you can turn them off at any time in the App's Settings, as described in our Privacy Policy. Only send photos of food or menus, and only words about what you eat. Do not send anything illegal, explicit or harmful, anything that is not yours to share, or anything meant to make the AI do something other than read food. Your use of AI features must also follow Google's Generative AI Prohibited Use Policy, since the AI service is provided by Google. We may limit or suspend AI features for an account that breaks these rules.
Fair use. AI features have daily limits, set so that normal use never reaches them. Without a subscription, the Craving Solver can be used 3 times a month, and the uses come back on the 1st of each month.
Our right to close accounts. We may suspend or close an account that breaks these Terms, for example one used to promote dangerously restrictive eating, after telling you why where the law requires.
5. Intellectual Property & Limited License
Ownership. All software code, graphical elements, database architectures, interfaces, visual designs, brand names, and algorithms across the Services are the exclusive property of NCWB LTD or its licensors.
License grant. NCWB LTD grants you a limited, revocable, personal, non-transferable, non-sublicensable, and non-exclusive license to download and use the App strictly for your individual, non-commercial purposes on compatible devices.
Restrictions. You agree not to:
- Reverse engineer, decompile, disassemble, or attempt to derive the source code of the App.
- Use crawlers, scrapers, automated scripts, or bots to harvest or extract food databases, craving items, or backend API responses.
- Sublicense, resell, rent, lease, or commercially exploit any portion of the App or Services.
- Bypass, manipulate, or attempt to disable digital entitlement checks, subscription paywalls, or RevenueCat validation logic.
6. Disclaimer of Warranties
To the maximum extent permitted by applicable law, the Services, content, Apple Health integration and automated suggestions are provided on an "as is" and "as available" basis without warranties of any kind, whether express, implied, or statutory. NCWB LTD disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, title, accuracy, and non-infringement. We do not guarantee that the Services will be uninterrupted, error-free, secure, or accurate in estimating calories, macronutrients, portions, biometric syncing, or dietary outcomes, including estimates made by AI features.
7. Limitation of Liability
Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, or any other liability that cannot be excluded or restricted under the laws of England and Wales.
Subject to the above and to the maximum extent permitted by applicable law:
- NCWB LTD shall not be liable for any indirect, incidental, special, exemplary, punitive, or consequential damages, or loss of data, profits, goodwill, device integrity, or revenue.
- NCWB LTD's total aggregate liability arising from or relating to these Terms or your use of the Services shall be limited to the greater of: the total subscription fees paid by you to us via the App in the preceding twelve (12) months, or £100.00 GBP (or USD $100.00).
8. Governing Law & Dispute Resolution
Governing law. These Terms and any dispute or claim arising out of or in connection with them (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of England and Wales.
Jurisdiction. The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms, except that consumers resident in Scotland or Northern Ireland may also bring proceedings in their local courts.
Informal dispute resolution. Before commencing formal legal proceedings, you agree to contact us at team@foodcheaterapp.com to attempt to resolve any dispute in good faith for at least thirty (30) days.
